General

These general terms and conditions apply to booking confirmations regarding accommodations rented out by ‘Zevende Hemel’ Chamber of Commerce number 83886044.
‘Zevende Hemel’ does not own accommodations (holiday homes) but rents and mediates on behalf of private owners for short-term recreational use.
The tenant who makes a booking through ‘Zevende Hemel’ is jointly and severally liable for fulfilling all obligations, both for themselves and their fellow travelers, arising from the booking.

Website

‘Zevende Hemel’ excludes all liability for any damage, direct or indirect, of any kind, arising from or in any way related to the use of our website. No legal liability can be derived from the images of the displayed accommodations. Only the details mentioned in the booking confirmation are binding.

Reservation

You can book one of our accommodations online or via email. When finalizing the online reservation, you will pay a deposit of 30% of the rental amount. After receiving the deposit, you will immediately receive written confirmation of your booking from ‘Zevende Hemel.’
Thirty days before your arrival date, you will receive an email with a payment request for the remaining 70%. This amount must be paid within five working days.
If the payment of the remaining rental amount is not received on time (within five working days after the email was sent), we reserve the right to cancel your booking.

Cancellation

Unfortunately, situations may arise that force you to cancel or end your vacation early. We recommend purchasing cancellation insurance to ensure proper coverage in such cases. Booking cancellations must be made in writing only. ‘Zevende Hemel’ applies the following cancellation terms:

  • If canceled after paying the 30% deposit, your right to a refund of the paid amount expires.
  • If the remaining 70% rental fee is not paid or is paid late, your right to a refund of the deposit expires, and your reservation will be canceled.
  • If canceled after full payment of the rental amount, no refund is possible.
  • If you fail to arrive on the agreed arrival date or depart early, you are not entitled to a refund. You may transfer your booking to another party after consulting with ‘Zevende Hemel.’ The request must be submitted in writing at least seven days before arrival to allow ‘Zevende Hemel’ to make the necessary adjustments. (Your replacement must meet all booking conditions.)

Cancellation by ‘Zevende Hemel’

If unforeseen circumstances prevent us from fulfilling the booking, the tenant will immediately be offered a comparable or better accommodation as a replacement. If the tenant does not agree with this alternative, the already paid rental amount will be refunded. Further claims from the tenant are excluded in this case.

Liability of ‘Zevende Hemel’

‘Zevende Hemel’ acts solely as an intermediary between tenant and landlord and accepts no responsibility for any failure on the part of the landlord in any respect.

Duty of Cooperation and Liability

During the rental period, tenants and other users are fully liable for (and the consequences of) accidents, damage, and theft in and near the accommodation if these are attributable to them and/or their travel companions due to negligence, fault, or intent.
Tenants are also fully liable for any additional costs. ‘Zevende Hemel’ reserves the right to hold the tenant liable if caused damage has not been properly settled or if on-site costs have not been fully paid. All associated (collection) costs will be fully charged to the tenant listed in the booking confirmation.
Each tenant is required to report any damage caused by themselves or their party during the rental period.

‘Zevende Hemel’ is not liable for inconvenience or loss of rental enjoyment in cases of nearby construction work (e.g., road or building works), increased tourist activity, or other events.
‘Zevende Hemel’ is not liable for the failure or malfunction of technical equipment, utilities, or internet services.

Over-occupancy and Pets

The presence or use of more people than agreed upon in the booking is strictly prohibited. Over-occupancy will result in immediate termination of the contract without compensation. The specified number of people includes children and babies. This also applies to bringing pets if not mentioned in the contract.

Group Composition & Property Use

We primarily arrange rentals for families and couples. Youth groups must inform us at the time of booking if they are booking as such. A ‘youth group’ is defined as at least four (4) people, primarily under 27 years of age. We or the property owner reserve the right to refuse a group booking or terminate it without refund if this information was not provided at booking. Additional group composition restrictions may apply, which will be mentioned in the accommodation description on our website. You must comply with any restrictions or requirements mentioned in the accommodation description.
‘Zevende Hemel’ and the landlord have the right to refuse a booking based on age or group composition. Subletting or re-renting is prohibited. The property may not be used for commercial purposes or as a party venue.

Complaints

If something is wrong with your booked accommodation or if it does not match the description, you are obliged to inform ‘Zevende Hemel’ immediately. We will do our best to resolve the issue as soon as possible. If your complaint cannot be resolved satisfactorily, you must formally submit it in writing within seven days after your stay. Leaving the accommodation without notifying ‘Zevende Hemel’ about your complaint will result in the loss of all rights to compensation or reimbursement. ‘Zevende Hemel’ takes complaints seriously and will do its best to make your vacation as memorable as possible.
